Practice Areas

Former German citizens and their descendants who were deprived of their German citizenship between January 30, 1933, and May 8, 1945 due to the discriminatory legislation of the Nazi state can have their citizenship restored.

The basis for this is Article 116 paragraph II of the Basic Law (Grundgesetz) of the Federal Republic of Germany.

Victims of Nazi persecution and their descendants can be granted German citizenship under certain conditions if they have suffered disadvantages under the German discriminatory laws at the time. This may even apply if they or their ancestors were not German.

The basis for this is § 15 of the German Citizenship Act (Staatsangehörigkeitsgesetz).

Since 2021 people who were either unable to acquire German citizenship by birth or who lost their German citizenship acquired by birth due to previously existing gender-discriminatory provisions in the German Citizenship Act can be naturalized in Germany since 2021. This also applies for their descendants.

The basis for this is § 5 of the German Citizenship Act (Staatsangehörigkeitsgesetz).

In addition to practicing citizenship law Julius Kaspar Niesert is a partner at the law firm S + N Rechtsanwälte which focuses on art restitution law.
